Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("you") and Nestosai ("Nestosai", "we", "us") and govern your access to and use of the Nestosai mobile application, website, and related services (the "Service"). By creating an account, downloading, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service (16 in the EEA where required by local law). If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf. See the Children's Privacy page for details.

2. Your account

• You are responsible for the accuracy of the information you provide and for keeping your credentials confidential.
• You are responsible for activity that happens under your account.
• Notify us promptly at support@nestosai.com if you suspect unauthorized use.

3. The Service

Nestosai provides AI-powered private reflection, parenting coaching, family insights, and (where enabled) facilitated family conversations. The Service may evolve over time; features may be added, changed, or discontinued.

4. AI-generated content

Responses, suggestions, summaries, transcriptions, and other outputs produced by the Service are generated by artificial intelligence and may contain errors, omissions, or content that is offensive, inaccurate, or otherwise inappropriate. You are responsible for evaluating any output before relying on it. AI output is not professional advice and is not a substitute for qualified human judgment.

5. Acceptable use

You agree not to use the Service to:

• Violate any law or the rights of others.
• Harass, threaten, abuse, exploit, or endanger any person, including any child.
• Generate or distribute sexual content involving minors, content promoting self-harm or violence, or content that violates Apple's or Google's marketplace guidelines.
• Attempt to extract, train on, or reverse-engineer the underlying AI models or our systems.
• Probe, scan, or test the vulnerability of the Service without authorization, or interfere with its operation.
• Impersonate another person or misrepresent your affiliation.
• Submit content you do not have the right to submit, including another person's confidential or personal information without their consent.

We may investigate and take action against suspected violations, including removing content and suspending or terminating accounts.

6. Your content

You retain ownership of the messages, voice recordings, photos, and other content you submit ("User Content"). You grant Nestosai a worldwide, non-exclusive, royalty-free license to host, store, transmit, process, and display your User Content solely as necessary to operate, secure, improve, and provide the Service to you and to those you choose to share with. We do not use your User Content to train general-purpose AI models. This license ends when you delete the content or your account, except for backups retained for a limited period and content others have been authorized to keep.

7. Family / Nest features

Nestosai allows you to form a household ("Nest") and to share certain insights or messages with other members. You are responsible for deciding what to share and with whom. Even where the Service offers privacy controls between members, you should not assume any message, insight, or behavior is hidden from other members of your Nest in all contexts. Do not share information about other people without their informed consent.

8. Subscriptions & billing

Some features may require a paid subscription. If you purchase a subscription through the Apple App Store or Google Play, billing, renewal, cancellation, and refunds are handled by the respective store under its own terms. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your store account settings.

9. Third-party services

The Service relies on third-party providers (for example, cloud hosting, AI model providers, analytics, push notifications). Their terms and privacy policies apply to the parts they provide. We do not control and are not responsible for third-party services or sites linked from the Service.

10. Intellectual property

The Service, including its software, design, branding, and content (excluding User Content), is owned by Nestosai or its licensors and is protected by intellectual property laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose, subject to these Terms.

11. Termination

You may stop using the Service and delete your account at any time (see Account Deletion). We may suspend or terminate your access if you violate these Terms or to protect users, our business, or third parties. Sections that by their nature should survive termination will survive (e.g. ownership, disclaimers, limitations of liability, governing law).

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT AI OUTPUT IS ACCURATE, RELIABLE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR PURPOSE.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NESTOSAI AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, REVENUES, OR DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) USD 50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, IN WHICH CASE THIS SECTION APPLIES TO THE FULLEST EXTENT PERMITTED.

14. Indemnity

You agree to indemnify and hold harmless Nestosai and its affiliates from any claim, loss, or expense (including reasonable legal fees) arising from your User Content, your use of the Service, or your breach of these Terms.

15. Governing law & disputes

These Terms are governed by the laws of the jurisdiction in which Nestosai is established, without regard to conflict-of-laws rules. Disputes will be resolved by the competent courts of that jurisdiction, unless mandatory consumer-protection law of your country of residence provides otherwise.

16. Apple-specific terms (if you obtained the app from the Apple App Store)

• These Terms are concluded between you and Nestosai only, not with Apple. Nestosai (not Apple) is solely responsible for the Service and its content.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple, who will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation.
• Nestosai is responsible for product claims, intellectual property infringement claims, and consumer-protection compliance, subject to these Terms.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and you are not on any U.S. Government restricted-party list.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

17. Changes to these Terms

We may revise these Terms from time to time. If a change is material, we will give you reasonable notice through the app or by email before it takes effect. Your continued use of the Service after the effective date of the updated Terms constitutes acceptance.
